Terms of Service
Lofoten Car Hire AS, Vendalsjorden 28, Bøstad, org nr 933 260 658 MVA, operates a car rental service where businesses and consumers can rent cars for mutual benefit by ordering cars online, picking up and returning at Leknes Airport or agreed upon location.
1. General
These terms apply to rentals and services from www.LofotenCarHire.no to businesses and consumers. The terms, together with your order, will constitute the entire agreement for the purchase.
2. Definition of Parties
- Lessor or Seller: Lofoten Car Hire AS, referred to as we, us, lessor, or Lofoten Car Hire AS.
- Lessee: The person specified as the lessee or buyer in the order, referred to as lessee, customer, you, your, or yours.
- Rental Objects: Cars, equipment, accessories, and everything else rented out on LofotenCarHire.no.
- Delivery Method/Service Points: Delivery or return at Leknes Airport or a location agreed upon at the time of purchase.
3. Payment, Deposit, and Prices
Payment is made via Visa or Mastercard online through our payment provider DIBS, which meets the strictest security requirements. The lessee pays at the time of ordering, and the rental agreement is considered concluded. Lofoten Car Hire follows common rental practices and also reserves a deposit amount specified on the order confirmation upon ordering. This reservation secures the company in case the customer returns the rental object late, damages it, or does not return it at all. Non-return will be reported to the police. The deposit amount varies with the chosen equipment and is stated in your order confirmation. Lofoten Car Hire has the right to use the deposit to cover rental and other costs mentioned above and/or any recourse claims, cf. point 5 below.
All prices include VAT unless otherwise specified. The total cost of the purchase will appear before ordering and include all direct expenses associated with the rental or purchase. Ferry, parking fees, tolls, fines, or other costs incurred by the user during the rental period will be invoiced to the customer by Lofoten Car Hire. If there have been significant pricing errors on the website from Lofoten Car Hire's side, Lofoten Car Hire can unilaterally change, delete, or reject orders even after the customer has received an order confirmation or similar. Such errors must, however, be corrected and the customer informed within a reasonable time after the error is discovered.
The cars are always delivered with a full tank of petrol. They must always be returned with a full tank. Failure to do so will result in a deduction from the deposit for the cost of the missing fuel, plus a fee of 500 NOK.
4. Condition of Rental Objects
Lofoten Car Hire commits to delivering rental objects of high quality in operational condition. Lofoten Car Hire has its own routines to check and maintain rental objects before and after rental. You are responsible for all damages or loss of equipment during the rental period. Exemption from responsibility may occur if the damage or loss is due to technical faults or defects. The lessee is therefore obliged to check the rental object before use and contact Lofoten Car Hire if the rental object is not in the expected condition.
5. Damages
If there are damages to the vehicle before it is put into use, this must be documented and reported to Lofoten Car Hire before the object is used. Failure to do so may result in you being held responsible for the damage.
All damages, technical faults, or accidents that may occur during the rental period must be reported to Lofoten Car Hire immediately. We will then do our best to assist the lessee. Damages must be reported to Post@lofotenCarHire.no immediately. This also applies in case of theft.
The vehicle is insured with a deductible of 10,000 NOK. This amount is the lessee's responsibility from the start of the rental period. In the event of damage to the vehicle, this amount will be deducted from the customer. In the case of recourse by the insurance or any other reduction in the settlement, the customer has the full economic responsibility. By entering into this rental agreement, you, as the customer, agree that it is your financial obligation to Lofoten Car Hire to compensate for damaged property, third-party damaged property, restitution, compensation, or any other form of reimbursement.
Lofoten Car Hire takes no responsibility for the misuse of the vehicle or any other form of illegal activities. You, the customer, commit to following all Norwegian laws when entering into this rental agreement. Lofoten Car Hire assumes no legal or financial responsibility regarding the use and any other form of connection to the vehicle on behalf of the lessee. Your rented product is insured according to Norwegian legislation, and this forms the full legal responsibility that Lofoten Car Hire assumes.
If damages occur due to misuse, intentionality, or negligence, Lofoten Car Hire may use the reserved deposit and, if necessary, deduct additional outstanding amounts to cover the costs of repair, service, or replacement of damaged property. This also applies if the equipment is returned poorly looked after or dirtier than usual.
We always strive to provide the best advice and tips for using the rental object, but we are not responsible for execution, or for direct or indirect damages, or losses resulting from the use of the rental object, delays, or faults in the rental object.
In the event of a need for roadside assistance, a deductible of 2,000 NOK will apply.
The customer is legally responsible for ensuring that the correct type of fuel is used when refueling the vehicle. Any damages resulting from incorrect fueling will be the sole financial responsibility of the customer, including repair costs and associated fees. Failure to adhere to this requirement may lead to additional charges and penalties. It is imperative for the customer to exercise caution and diligence when refueling to avoid such liabilities.
Smoking is not allowed in our cars. Violation of this policy will result in a cleaning fee charged to the customer.
6. Use of the Rental Object
Use of rental objects is at your own risk. All drivers must be over 18 years old and have a valid driver's license. The driver's license must be valid in Norway. The lessee is responsible for ensuring that the equipment and accessories are used in such a way that they are not damaged or unreasonably worn. Proper and safe use of the equipment is the lessee's responsibility. The lessor facilitates the proper use of the equipment by instructions, and safety procedures available with the rental object and/or on the lessor's website. It is the customer's responsibility to familiarize themselves with the lessor's usage and safety procedures before using the equipment.
We require the use of safety equipment. You must also follow the rental object's user manual and other instructions from Lofoten Car Hire.

**Disclaimer of Liability for SUP Board Use**
At Lofoten Car Hire, we provide SUP boards as an optional accessory for your convenience and enjoyment. However, we want to make it clear that we do not assume any responsibility for any injuries or fatalities that may occur as a result of using the SUP boards.
By using the SUP boards, you acknowledge and accept that all associated risks are your sole responsibility. We recommend following all safety guidelines and using the boards responsibly. Lofoten Car Hire is not liable for any damage, injury, or loss arising from the use of the SUP boards.
Your safety is important to us, and we encourage you to exercise caution and use appropriate safety equipment.
7. Accessories
The website describes what is included in the delivery of the rental object. In addition, safety equipment is required and offered on the website. For accessories that are sold and not used, point 12 Right of Withdrawal applies.
8. Lessee's Rights and Obligations
The lessee must be at least 18 years old and provide correct customer details when creating an account to order and rent on Lofoten Car Hire. The company name sends messages to the specified email, address, and phone number, and such messages are considered received and valid upon dispatch from us.
The user account is personal, and if you suspect that others have access to your account, you are obliged to notify Lofoten Car Hire immediately. Lofoten Car Hire has the right to freely reject, terminate, or suspend the user account without notice or liability, including if the terms are considered breached.
Furthermore, these rental terms must be accepted before ordering on the website. The lessee must return the rental object before the agreed date and time expire and in the agreed delivery form. The lessee is expected to keep informed about the normal opening hours of the service point.
The lessee or cardholder authorizes Lofoten Car Hire to create credit card instructions for, among other things, rental objects that are not returned, are dirtier than usual, or are damaged. The given authorization also includes the right to charge the payment card for additional rental/compensation claims if the rental object is returned after the agreed rental period or returned with faults or deficiencies.
Delays in returning the rental object beyond 1 hour from the agreed rental time entitles the lessor to one extra day's rental plus an additional fee, currently 500 NOK, which covers the extra costs Lofoten Car Hire incurs due to the late return. If the rental object is not returned after one day, Lofoten Car Hire is entitled to claim the agreed doubble daily price as long as the property is actually used and not returned by the lessee.
9. Order Changes
To change an order, Lofoten Car Hire must be contacted. The changes will not be valid until confirmed in writing by us. This ensures that the rental objects are indeed available. Unless otherwise agreed and confirmed, the rental object must be returned at the agreed time. Extension of the rental period can occur before the rental period starts and/or during the rental period by changing the rental start or rental end.
Changes and cancellations of rental objects that affect the availability of rental objects for other users may be subject to a change fee to cover rebooking costs. The change fee is currently 500 NOK. All costs will be communicated to the lessee before the order is placed or changed.
Cancellation Policy:
- Up to 48 Hours Before Pickup: You can cancel your reservation without any penalty, and you will receive a full refund of your deposit.
- Less Than 48 Hours Before Pickup:
The rental period will be charged in full.
10. Delivery and Return
Delivery and return take place in the manner, at the location, and at the time specified on the order confirmation. We are responsible for the products until they are taken over by you, i.e., when you have received the products in your possession. To receive the rental object, you must have your booking reference. The name you provide on the reservation must match the name on the ID card upon pickup.
If the delivery of the rental objects is delayed, we will inform you as soon as we know, along with information about and possibly when delivery can occur, or if the product(s) are out of stock or the rental object(s) are not available.
You are responsible for the product until it is returned to us or our service points. We check the rental objects' condition and function and ensure all parts are present when they arrive at our warehouse. Upon complete delivery in contractual condition, the reservation for the deposit on the payment card will be canceled.
If forgotten items are discovered, they will be stored for up to 30 days before being disposed of or redistributed.
11. Right of Withdrawal on Purchases
The Right of Withdrawal Act gives you the right to cancel your purchases. The right of withdrawal applies to items that are purchased and not to rental objects. The right of withdrawal assumes that you notify us within 14 days after receiving the delivery (See the Right of Withdrawal Act https://lovdata.no/dokument/NL/lov/2014-06-20-27 ).
To use the right of withdrawal, the product must be returned to us in approximately the same quantity and condition as you received it. If you try, use, or examine the item (open packaging, etc.) if usage, examination, or testing of the product goes beyond what is necessary to ascertain its nature, characteristics, and functionality, resulting in a reduction in the product's value, we reserve the right to deduct an amount equivalent to the decrease in value from the refundable purchase price. The product should be returned to us in its original packaging and within a reasonable time, along with the withdrawal form. The easiest way is to return the item in the same box as when you received the rental item. There will be no costs for you in this case. Please fill out the withdrawal form and place it in the box. If you choose to return it by mail or other methods, it is your responsibility until the item reaches us. You must ensure suitable packaging and contact us before sending it.
12. Intellectual Property Rights
The content and service are protected by copyright law. The images on the site are used with permission from the rights holders. Videos on YouTube are links to third-party services outside of Lofoten Car Hire's control.
13. Privacy
Lofoten Car Hire processes your personal information in a secure database to fulfill its obligations and protect its rights under the rental agreement. The personal information processed includes name, address, phone number, email address, and order history. This history will be stored for accounting and other obligations. All stored information is available on "My Account." The renter has the right to have their personal information removed from the lessor's systems, which can be done by personally contacting Lofoten Car Hire.
Your payment card will be stored as long as you have an active order. Storage of the payment card is done by our payment provider DIBS. They store the information securely. Storing the payment card makes it even easier when you shop. You can delete the payment card on your page. Lofoten Car Hire does not store any credit card details itself.
The company uses cookies, like most other online stores. Cookies store data in your browser so that the website can recognize you from page to page and visit to visit. We can then recognize who you are, allowing you to get the correct prices and easier login. We also collect usage information to improve the quality of the service.
Our vehicles are equipped with GPS tracking. We reserve the right to have and use this feature during and after the rental period if necessary.

14. Governing Law
These terms are subject to and shall be interpreted in accordance with Norwegian law. The agreed legal venue is Lofoten District Court.
15. Changes
Lofoten Car Hire reserves the right to change or replace these terms at any time. The current terms are always available on LofotenCarHire.no. If Lofoten Car Hire considers the changes to the terms to be significant to the renter's rights or obligations, the changes will be made available on LofotenCarHire.no 30 days before they take effect.
By using the service after the changes to the terms are made available on LofotenCarHire.no, you agree to be bound by the updated terms. If you do not wish to accept the new terms, you cannot use Lofoten Car Hire.
